Welcome to BySillage. By using our marketplace, you agree to the following terms.

Buyers must pay within 24 hours of purchase.

Sellers must ship within 2 business days.

1. About the Platform

BySillage is a fragrance-exclusive resale marketplace that connects buyers and sellers of authentic, pre-owned, and new fragrances. BySillage operates as an intermediary and, except where explicitly stated, is not a party to the underlying sale between Buyer and Seller.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account.
You must provide accurate, current, and complete information during registration and keep it up to date.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
BySillage may require identity verification for account creation, seller status, or high-value transactions.

3. Seller Tiers and Badges

Sellers progress through tiers based on transaction history and platform tenure. Tier status determines fund access speed, fees, listing review requirements, and protection defaults

4. Listings and Item Authenticity

Sellers must accurately describe the fragrance, including brand, size, fill level or remaining volume, batch/lot information where available, and condition.
Listings are subject to the review process applicable to the Seller's tier before going live, as described in Section 3.
BySillage may remove, suspend, or decline to publish any listing that it believes, in its reasonable judgment, is inaccurate, counterfeit, prohibited, or in violation of these Terms.
Sellers are solely responsible for the authenticity and legality of items listed. Knowingly listing counterfeit or misrepresented items is grounds for immediate suspension and forfeiture of pending payouts related to the item(s) in question.

5. Orders, Payments, and Escrow

All payments for completed orders are processed through the Platform's designated payment processor and held in escrow until the applicable release conditions are met (e.g., delivery confirmation, inspection period expiration, or dispute resolution).

5.1 Payout Timing

Payout initiation: Once escrow is released, BySillage initiates the Seller's payout the same business day. There is no additional internal holding period between escrow release and payout initiation.

Total time to funds: Total time from order completion to funds reaching the Seller's bank account is approximately 6–7 days, subject to the Seller's tier, banking institution, and payment processor timing.

New Seller Badge: Bank transfer in transit 1–2 business days following payout initiation; instant payout is not available.

Standard Seller Badge: Discounted transfer fees apply to standard bank payouts.

Pro Badge: Instant payout to bank is available at no transfer fee, subject to payment processor and banking network availability.

6. Buyer Protection and Seller Protection

Buyer Protection and Seller Protection are risk-mitigation programs offered on the Platform. Their default status (mandatory vs. optional) varies by Seller tier as set out in Section 3. Full program terms, coverage limits, and claims procedures are set out in a separate Buyer/Seller Protection Policy, incorporated into these Terms by reference.

7. Prohibited Conduct

Listing counterfeit, stolen, recalled, or misrepresented items.
Circumventing the Platform's payment, escrow, or fee systems, including directing transactions off-platform to avoid fees.
Manipulating reviews, ratings, seller tier progress, or Platform metrics.
Harassing, threatening, or defrauding another User.
Using the Platform for any unlawful purpose or in violation of applicable import/export, hazardous materials, or consumer protection laws.

8. Returns, Refunds, and Disputes

Eligibility for returns or refunds depends on the item condition upon receipt, the accuracy of the listing, and any applicable Buyer or Seller Protection coverage. Disputes are handled through the Platform's resolution process; escrowed funds are held pending resolution and are not released to the Seller until the dispute is closed.

9. Account Suspension and Termination

BySillage may suspend or terminate a User's account for violation of these Terms, fraudulent activity, chargeback abuse, or repeated authenticity or quality complaints. Users may close their account at any time; obligations relating to pending orders, payouts, or disputes survive account closure until resolved.

10. Changes to These Terms

BySillage may update these Terms from time to time. Material changes will be communicated to Users through the Platform or by email in advance of the effective date. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

11. Disclaimers and Limitation of Liability

The Platform is provided “as is” and “as available.” BySillage does not guarantee uninterrupted or error-free operation. To the maximum extent permitted by law, BySillage's aggregate liability arising out of or relating to these Terms or use of the Platform is limited to the fees paid by the User to BySillage in the twelve (12) months preceding the claim.
